Terms of Service
Important: HomeOfferFlow is software for organizing information and generating Texas real estate offer paperwork. HomeOfferFlow is not a law firm, does not provide legal advice, and does not represent you as a real estate agent or broker.
1. Who We Are
HomeOfferFlow is operated as a product of BrewBQ Investments LLC (“HomeOfferFlow,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of homeofferflow.com and related services.
2. What HomeOfferFlow Does
HomeOfferFlow provides an online guided workflow that helps users enter information and generate real estate offer-related documents, including Texas Real Estate Commission (“TREC”) forms and related offer packet materials based on user-provided information.
HomeOfferFlow is a form-completion and document-generation software tool. We do not guarantee that any offer will be accepted, enforceable, complete for your particular situation, or appropriate for any specific transaction.
3. No Legal Advice, Brokerage, Agency, or Fiduciary Relationship
HomeOfferFlow is not a law firm, attorney, real estate brokerage, real estate broker, real estate sales agent, title company, lender, escrow agent, or transaction coordinator. Use of HomeOfferFlow does not create an attorney-client relationship, broker-client relationship, agency relationship, fiduciary relationship, or representation agreement.
We do not negotiate for you, represent you, advise you on legal rights, interpret legal documents for your specific situation, or track transaction deadlines on your behalf.
4. User Responsibility
You are solely responsible for:
- entering accurate and complete information;
- reviewing every document before using, sending, or signing it;
- confirming that all required addenda, notices, disclosures, and signatures are included;
- determining whether to consult a licensed Texas real estate agent, broker, attorney, lender, title company, inspector, or other qualified professional;
- submitting documents to the appropriate party;
- tracking deadlines, notices, option periods, financing periods, inspection periods, and closing obligations;
- reviewing all counteroffers, amendments, revised documents, and signature requests before signing.
5. One-Time Generated Offer Packet
Unless expressly stated otherwise in writing, the core HomeOfferFlow purchase provides one generated offer packet based on the information you enter at the time of generation. It does not include ongoing transaction management, amendment preparation, negotiation support, deadline tracking, contract revision monitoring, or representation after generation.
If a seller, listing agent, title company, lender, or other party requests changes, sends a counteroffer, or provides revised documents, you are responsible for reviewing those changes before signing or relying on them.
6. TREC Forms and Texas-First Scope
HomeOfferFlow currently focuses on Texas real estate offer workflows and may use TREC-promulgated forms. TREC forms are public records and available to the public, but they are primarily intended for use by licensed real estate brokers and sales agents who are trained in their correct use. You accept the risk of using any generated document without professional review.
7. Paid Services, Final Sale, and Refunds
HomeOfferFlow may charge fees for offer packet generation, showing requests, review options, support options, or other services. Due to the digital nature of generated documents and services, all sales are final once payment is processed or a document, confirmation, or service request has been generated, unless we choose to issue a refund at our sole discretion.
8. Optional Review or Support Services
Some plans may reference agent review, attorney review, agent support, attorney support, or similar add-on services. Unless and until a separate written engagement or representation agreement is signed with a qualified professional, purchasing or requesting such an option does not itself create legal representation, brokerage representation, agency representation, or fiduciary duties.
9. Showing Requests
Showing request services, if offered, are coordination requests only unless expressly stated otherwise. A showing request does not create buyer representation, agency representation, or a brokerage-client relationship with HomeOfferFlow.
10. No Guarantees
We do not guarantee that documents generated through HomeOfferFlow will be accepted by a seller, listing agent, lender, title company, broker, attorney, court, government agency, or any other party. We do not guarantee transaction success, financing approval, appraisal results, inspection results, legal sufficiency, or enforceability.
11. Acceptable Use
You agree not to misuse the service, submit false or fraudulent information, interfere with the operation of the site, attempt unauthorized access, copy or resell the software, or use HomeOfferFlow for unlawful purposes.
12. Third-Party Services
HomeOfferFlow may use third-party services including payment processors, email providers, hosting providers, electronic signature providers, analytics providers, mapping/address providers, and other technology vendors. Their services may be governed by their own terms and privacy policies.
13. Limitation of Liability
To the maximum extent permitted by law, HomeOfferFlow and its owners, operators, affiliates, contractors, vendors, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, lost profits, lost opportunity, failed transactions, missed deadlines, rejected offers, financing issues, title issues, inspection issues, or legal disputes arising from or related to your use of the service.
To the maximum extent permitted by law, our total liability for any claim related to the service will not exceed the amount you paid HomeOfferFlow for the specific transaction giving rise to the claim.
14. Indemnification
You agree to defend, indemnify, and hold harmless HomeOfferFlow and its owners, operators, affiliates, contractors, vendors, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from your use of the service, your submitted information, your transaction, your documents, your breach of these Terms, or your violation of law or third-party rights.
15. Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute will be handled in a court of competent jurisdiction in Texas unless otherwise required by law.
16. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date. Continued use of the service after updates means you accept the updated Terms.
