Electronic Communications and E-Sign Consent

Please read carefully. By affirmatively selecting the related acceptance box or using an electronic-signature workflow after this disclosure, you agree to receive the records described below electronically. You may decline or withdraw consent as described below.

1. Scope of Consent

To the extent permitted by applicable law, you consent to receive electronically the Terms of Service, Privacy Policy, Disclaimer, this consent, receipts, invoices, subscription and renewal notices, account notices, document links, signature requests, audit and status records, support communications, and other information relating to HomeOfferFlow. We may deliver them through the Services, your account dashboard, the email address you provide, or an independent electronic-signature provider used for the workflow.

This consent applies to your relationship with HomeOfferFlow. A transaction document may involve separate consents, disclosures, or delivery practices of a brokerage, counterparty, lender, title company, electronic-signature provider, or other participant. Nothing here requires any person to accept an electronic record or signature where law or the applicable transaction does not permit it.

2. Electronic Signatures and Records

When you request, send, access, or sign a document electronically, you agree to conduct that transaction electronically to the extent permitted by law. You authorize HomeOfferFlow to transmit documents and signer information to the electronic-signature provider selected for the workflow. You remain responsible for confirming that electronic signatures are appropriate, authorized, complete, and legally sufficient for your transaction.

Electronic records and signatures are not denied legal effect solely because they are electronic where applicable law permits them, including under the federal E-SIGN Act and the Texas Uniform Electronic Transactions Act. Those laws do not make every record or transaction eligible for electronic execution, and HomeOfferFlow does not determine eligibility for you.

3. Hardware and Software Requirements

To access and retain electronic records, you need: (a) a current internet-connected desktop, laptop, tablet, or mobile device; (b) a current major web browser with JavaScript and cookies enabled; (c) a valid email address; (d) software capable of viewing Portable Document Format (PDF) files; and (e) sufficient electronic storage or a printer if you want to retain paper copies. You should keep your email address current and check spam, junk, and filtered folders. You may print or save a copy of these records for your files.

If a material change to these requirements creates a material risk that you cannot access or retain a record that is the subject of this consent, we will provide notice of the revised requirements and your right to withdraw consent without undisclosed consequences.

4. Paper Copies and Updating Contact Information

You may request a paper copy of a HomeOfferFlow record that we can reasonably provide by emailing support@homeofferflow.com with the subject “Paper Copy Request.” Identify the record, the account email, and a mailing address. We may charge a reasonable fee only where permitted by law and disclosed before processing the request. You are responsible for updating your contact information through your account or by contacting support.

5. Withdrawal of Consent

You may withdraw consent to electronic communications by emailing support@homeofferflow.com with the subject “Withdraw E-Sign Consent,” using the account email address and stating that you withdraw consent. Withdrawal is effective after we have had a reasonable opportunity to process it. It does not affect the legal effect, validity, or enforceability of records, communications, transactions, or signatures completed before withdrawal.

Withdrawal may prevent us from providing features that require electronic delivery, may require cancellation of an account or subscription, and may result in paper-delivery fees only if permitted by law and disclosed to you. We will not impose a fee or consequence for withdrawal that was not disclosed before you consented, except as permitted by law. Certain notices may still be delivered electronically or otherwise as permitted by law.

6. Your Responsibilities and Record Retention

HomeOfferFlow does not verify every signer’s identity, authority, capacity, intent, or receipt of a signature request. You must review all document and recipient details before sending, review the completed signed document and available audit materials, and retain appropriate copies. Do not rely on HomeOfferFlow as your only recordkeeping system.
